Small Entity

A small entity is any legal entity that employs less than 500 people and a large entity is any legal entity that employs 500 or more people, including part-time workers, on average. Not for profit organizations may be eligible for small entity status.

The following is a procedure for changing the USPTO fee schedule that PatentEase uses to estimate the patent application filing fee.

From the main PatentEase screen select “Options…” from the Tools pull down menu. This will display the Options dialog.

On the Options dialog window select (click) the “PTO” tab. The PTO tab contains the USPTO patent application filing “Fees”. PatentEase uses the entered information to estimate filing fees; the applicant is ultimately responsible for verifying the current USPTO fee schedule and calculating filing fees.

The fees for a small entity to file a patent application effective December 8, 2004:

1011/2011 $150.00 Basic filing fee – Utility

1111/2111 $ 250.00 Utility Search Fee

1311/2311 $100.00 Utility Examination Fee

Total => PatentEase PTO Fees; Basic filing Fee: $500.00

1202/2202 $ 25.00 Claims in excess of twenty

Total=> PatentEase PTO Fees; Extra Claims: $25.00

The fees for a large entity to file a patent application effective December 8, 2004:

1011/2011 $300.00 Basic filing fee – Utility

1111/2111 $ 500.00 Utility Search Fee

1311/2311 $200.00 Utility Examination Fee

Total => PatentEase PTO Fees; Basic filing Fee: $1000.00

1202/2202 $ 50.00 Claims in excess of twenty

Total=> PatentEase PTO Fees; Extra Claims: $50.00

Update the “Fees” information by overwriting the “Basic filing fee”, “Extra Claims”, and “Fee Schedule” fields on the PTO tab.
